The Supreme Court on Tuesday struck out an appeal filed by the Peoples Democratic Party (PDP) and its candidate in the last presidential election, Atiku Abubakar.
The apex court in its ruling on the appeal marked SC/738/2019, filed against a ruling of the Presidential Election Petition Court (PEPC), struck out the appeal for having become statute-barred.

The PEPC had earlier held that the PDP and its presidential candidate in the last election, Atiku, do not have a response to an application filed on May 14, 2019, by the All Progressives Congress (APC) seeking among others, the dismissal of their (Atiku and the PDP) suit challenging President Muhammadu Buhari’s victory in the election.
The Supreme court gave the ruling, by a five-man panel led by Justice Datijo Mohammed.
